                                   PHASE 1 AUDIT

ENVIRONMENTAL
INSPECTION AND REPORTING

In the twenty-first century environmental surveys rely as much on files and data bases as they do on physical examination of property. The purpose of environmental inspections are twofold; to determine any existing or potential health hazards and to limit potential liability. The legal concept of due diligence requires thorough research into the history of a property as well as an examination of its current condition.  A Phase 1 Audit also involves research and documentation of hazardous conditions on other properties that could affect the subject property.  Groundwater contamination can spread from one property to another based on distance, relative elevation, ground water flow direction and velocity and other factors, and all these factors are analyzed.  Many banks and mortgage lenders require an Phase 1 Audit prior to final loan approval and ALL buyers should exercise "due diligence" and protect themselves from environmental liability at time of purchase, during ownership and at resale

CONFIDENTIAL REPORT
CERTIFIED TO BUYER - CERTIFIED TO LENDER UPON REQUEST

Attorneys strongly recommend or require Phase 1 Audits for their clients who purchase, own,  manage, develop or sell residential, commercial, industrial, institutional properties and vacant land with or without financing. There is simply no more effective way to defend against future environmental claims, whether meritorious or not, other than a professional Phase 1 Audit at the time of purchase and sale of a property.  Our Phase I Environmental Assessment constitutes " appropriate inquiry" (due diligence) for the purpose of an innocent landowner defense pursuant to the Comprehensive Environmental Response, Compensation and Liability Act, as amended, 42 USC 9601 et. seq. (CERCLA).

LIFESPACE CORPORATION accesses extensive national data networks to assemble historical and current information of environmental hazards on or near a subject property as well as flood plains, topographical and geological attributes and a variety of other indices. In addition, our trained and experienced Senior Inspector physically examines each site and nearby sites and confirms, verifies and reconciles observed conditions to all available data.

Realtors, real estate brokers, banks, mortgage lenders, mortgage brokers, attorneys, architects, engineers, developers, builders, buyers, owners and sellers rely on us for thorough inspections, comprehensive reports and fast, professional service.

ALL PHASE 1 REPORTS COMPLY WITH ASTM STANDARD E-1527-05

Please note:  A Phase 1 Environmental Audit meets the due diligence requirement to establish an innocent landowner defense under CERCLA.  In addition, a Phase 1 Environmental Audit dated at the time of sale is a powerful defensive tool against a future claim with or without merit.  This is important because a property owner faced with environmental liability is likely to attempt to "spread the risk" by involving past owners and the documentation of a Phase 1 Audit.  Since environmental liability can extend up to 25 years you need to begin protecting yourself or your company now for the future time when you no longer own the building.

ESA TRANSACTION SCREEN ASTM STANDARD E-1528-06

We also offer an ESA, also known as a Transaction screen, that is a much less extensive report based on minimal research.  This service is only appropriate for low-risk properties in low-risk neighborhoods.  This service does not meet the due diligence requirement to establish an innocent landowner defense under CERCLA.  Lenders will occasional request this lower cost service but generally require the depth, breadth and more complete protections of a Phase 1 Environmental Audit.
