The purpose of Due Diligence Phase 1 Environmental Assessment is to satisfy lenders, investors and buyers need to be aware of the presence or likely presence of any hazardous substances in buildings and underground on a property, and also the likely presence of any hazardous substances on other area properties that could travel underground and contaminate the subject property.

Please Note:  Phase 1 Environmental Assessment often reveals relatively minor environmental problems that can be easily be corrected.  Rather than issue a negative report we'll advise you of any conditions that need to be addressed and provide you with the option to correct them before the Phase 1 Report is issued saving you the time and cost of additional reporting.

SCOPE OF PHASE 1 ENVIRONMENTAL ASSESSMENT

Phase 1 Environmental Assessment is a complex undertaking that includes several broad areas of inquiry:

User Responsibilities allows the user (you) the opportunity to contribute certain information that streamlines the process.  Any information that you are already aware of including and past Environmental Assessment of the property tax ID or tax map numbers, current owner's name and contact information, any history of the property that has been reported to you and your opinion of property condition.

Records Review involves a very detailed and labor intensive research project.  Over 60 federal, state and local databases are searched.  The Environmental Professional (us) evaluates and documents the thoroughness of the search, reviews and analyzes the information received. 

Historical Research often provides answers, questions, clues to past history of the subject property and properties in the immediate vicinity.  Remember that we're looking for the presence or likely presence of environmental hazards on the subject property and that very well could have originated on a neighboring property as a result of current or former use.  Insurance maps, city directories and interviews with property owners, tenants and neighbors are all part of this process.

Site Inspection can yield a wealth of information about the soil, topography, evidence of current or former storage tanks, chemical storage, materials dumped or stored on the property uses on neighboring properties.  The Environmental Professional (EP) will then reconcile this information with database records.  the EP may encounter "data gaps" that will be resolved within Phase 1 standard procedures or additional investigation in order to satisfy the user and his lender that any questions about the property have been reasonably resolved.

Geology, hydrology and typography are analyzed to determine porosity of the soil, depth of water table, direction and velocity of underground water movement and other physical attributes.  This information is invaluable in determining the potential of any environmental hazard migrating to or from the subject property and also the probability of vapor intrusion into buildings.

  In the twenty-first century environmental surveys rely as much on files and databases as they do on physical examination of property. The purpose of Phase 1 Environmental Assessment is twofold; to determine any existing or potential health hazards and to limit financial liability. The legal concept of due diligence requires thorough research into the history of a property as well as an examination and assessment of its current condition.  A Phase 1 Audit also involves research and documentation of hazardous conditions on other properties that could affect the subject property.  Groundwater contamination can spread from one property to another based on distance, relative elevation, ground water flow direction and velocity and other factors, and all these factors are analyzed.  Most investors, banks and mortgage lenders require an Phase 1 Audit prior to final loan approval and ALL buyers should exercise "due diligence" and protect themselves from environmental liability at time of purchase and also during ownership and at resale

ALL PHASE 1 REPORTS COMPLY WITH ASTM STANDARD 

Please note:  A Phase 1 Environmental Audit or Assessment meets the due diligence requirement to establish an innocent landowner defense under CERCLA.  In addition, a Phase 1 Environmental Audit dated at the time of sale is a powerful defensive tool against a future claim whether the claim is with or without merit.  This is important because a property owner faced with environmental liability is likely to attempt to "spread the risk" by involving past owners and the documentation of a Phase 1 Audit.  Since environmental liability can extend up to 25 years you need to begin protecting yourself or your company now for the future time when you no longer own the building.

 

ESA TRANSACTION SCREEN ASTM STANDARD E-1528-06

We also offer an ESA, also known as a Transaction screen, that is a much less extensive report.   This service is only appropriate for low-risk properties in low-risk neighborhoods.  Lenders will occasional authorize this lower cost service but generally require the depth, breadth and more complete protections of a Phase 1 Environmental Audit.
